1. DEFINITIONS

1.1. "Service" means the service We provide to You. We allow You to Post Your Profile, browse the website, contact and be contacted by other Users/Service Users and give You the facility to delete Your Profile at any time by using Your nominated password.

"Service User" means any individual who has submitted a profile.

"You, Your" means the individual who has submitted a profile and/or is using this service.

"Us, We, Our" means AWMP Creative Media PO Box 177 Penzance Cornwall TR18 2ZN UK.

"Post," means to submit information to the Service for display, exhibition, publication and transmission. Posted information is viewable by Users/Service Users of the Service.

"Profile" means the section constructed and posted by You containing details and/or information about you. We ask that You use only a nickname and an e-mail address which You have obtained solely for use of this service and that you do not disclose your usual e-mail address or any other personal information which could identify you.

"Adult" means aged 18 or over.

"User" means any individual who uses the service by browsing the Profiles Posted on the People section of IntoCornwall.com

2. ELIGIBILITY

2.1 This Service is for Adults only. ADULT IS DEFINED AS AGED 18 OR OVER. By accepting the conditions for using this Service, You are warranting and representing to Us that:

• 2.1.1You are aged 18 or over;
• 2.1.2 You have not been convicted of any offence of violence and/or any offence under the Protection from Harassment Act 1997(or any amendment to th e Act) or under any similar law in any other country; and/or
• 2.1.3 You have not been the subject of any injunction or any order to pay damages under the Protection from Harassment Act 1997 (or any amendment to the Act).

2.2 If You are unable or unwilling to give the warranties and representations stated by Us in clause 2.1, then please do not submit Your Profile and do not use this Service.

3 INDEMNITY BY USER/SERVICE USER

3.1 You agree to, indemnify, keep indemnified, and hold Us harmless for any and all losses, costs, claims, liabilities and expenses (including legal fees on an indemnity basis) relating to or arising out of Your use of this Service.

4 SERVICE USER OBLIGATIONS

4.1 You will not:

4.1.1 Post personal details such as your usual e-mail address, URL, telephone number, home and/or work address, name or any other personal details which could identify you;

4.1.2 use the Service to promote another site, service and/or business in any way;

4.1.3 solicit business from other Users/Service Users, buy or sell products and/or services through this Service;

4.1.4 misuse this Service or any information which is Posted on this Service in any way . Any misuse of this Service will result in the first instance in Us removing the information which constitutes a misuse of the Service but for for any further instances of misuse of this Service by You, We reserve the right to remove all information You have posted including deleting Your Profile;

4.1.5 Post misleading information in Your Profile;

4.1.6 Post and/or reproduce information where the Intellectual Property Rights belong to another party unless you have prior consent of that party to use the information;

4.1.7 Post information which could cause offence to other Users/Service Users. This includes any discriminatory language which is racist, sexist, obscene, profane of a sexual nature or which incites hate against any individual or group or which could offend other Users/Service Users religious and political beliefs.

4.2. You must:

4.2.1 Obtain an e-mail address which you will use solely for the purpose of using this Service. We have suggested some companies who provide e-mail addresses but the choice of e-mail address provider is Your decision and We do not endorse any particular provider;

4.2.2 use a nickname when You Post Your Profile. This nickname should be used when communicating with other Users/Service Users;

4.2.3 use this Service in a manner that is consistent with any and all relevant legislation, applicable laws and regulations.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 All Intellectual Property Rights in this Service shall be owned by Us.

6 DISCLAIMERS

6.1 We are not responsible for any inaccurate, incorrect or misleading information which is Posted on this Service.

6.2 We are not responsible for the behaviour, be it online or offline, of any User/Service User.

6.3 We are not responsible for any loss or damage, including personal injury or death, which arises from Your use of this Service.

7. CONTENT

7.1 We assume no liability for the content of any information Posted on this Service or for any reply to any information which You Post on this Service.

7.2 You assume complete liability for the content of all replies to any information which You have Posted on this Service.

7.3 We reserve the right but have no obligation to monitor the content of profiles and remove any information which constitutes a misuse of this Service.

8 YOUR PERSONAL PROFILE

8.1 By accepting these conditions You give Your permission for other Users/Service Users to view Your Profile.

8.2 You will be able to view the profiles of other Service Users.

8.3 You are responsible for Posting honest and accurate information to this Service.

9 DISPUTES

9.1 We assume no liability for any arrangements which You enter into with other Users/Service Users. We will not become involved in any dispute which arises between Users/Service Users. You are solely responsible for your interactions with other Users/Service Users.

10. PURPOSE OF THIS SERVICE AND PERSONAL SAFETY

10.1 This Service is an online facility for You to Post information about yourself and to allow You to contact other Users/Service Users, if You decide to make contact with them. You do not have to pay Us a membership fee for using this Service.

10.2 We do not have the possibility to check that profiles are accurate and honest and we are not under any obligation to verify any information Posted in any Profile.

10.3 It is not necessary for You to Post Your Profile in order to use this Service. You can browse Profiles Posted by Service Users.

10.4 This Service is for the personal use of individuals only and it cannot be used for any commercial purpose.

10.5 Your Profile will remain on this Service until You choose to delete it by accessing it with Your nominated password or, in the case of You misusing the Service, We reserve the right to delete it.

10.6 For Your own safety and peace of mind, please do not respond to information contained in a Profile until You have satisfied Yourself, through Your own time and expense, that it is safe to do so.

10.7 If You choose to arrange any meetings with any person through Your use of this Service then You do so at Your own risk. Please make sure that You take any precautions which You consider to be necessary to ensure Your own safety.

10.8 You use this Service entirely at Your own risk.
